利用規約

この利用規約（以下「本規約」といいます。）は、Round and Round（以下「当ショップ」といいます。）が運営するオンラインショップ（以下「本サービス」といいます。）をご利用いただく際の条件を定めるものです。本サービスをご利用いただくお客様は、本規約に同意したものとみなします。

第1条　適用

1. 本規約は、本サービスの利用に関して、お客様と当ショップとの間に適用されます。

2. 当ショップが本サービス上で掲載する配送、返品、お支払いその他のご案内は、本規約の一部を構成するものとします。

3. 本規約と個別のご案内の内容が異なる場合は、個別のご案内を優先します。

第2条　ご注文および売買契約

1. お客様が所定の方法により注文を行い、当ショップが注文を受け付けた時点で売買契約が成立するものとします。

2. 次のいずれかに該当する場合、当ショップはご注文をキャンセルし、または売買契約を解除できるものとします。

・ご注文内容に虚偽または不正が認められた場合

・決済が完了しない場合

・商品の欠品や破損などにより販売が困難となった場合

・長期不在や住所不明等により商品をお届けできない場合

・その他、当ショップが取引を継続することが適当でないと判断した場合

第3条　商品について

1. 当ショップでは、ヴィンテージ品など新品ではない商品を取り扱っています。

2. 商品には経年による傷、擦れ、色の変化、使用感などが見られる場合があります。これらは商品の特性であり、不良には該当しません。

3. 商品の状態はできる限り写真および説明文でお伝えしております。状態をご確認、ご理解のうえご購入ください。

4. 商品画像は実物に近い色味となるよう努めていますが、ご利用の端末や閲覧環境により実際の色味と異なって見える場合があります。

第4条　価格・在庫

1. 商品価格は、各商品ページに表示された価格とします。

2. 在庫管理には十分努めておりますが、ご注文のタイミングによっては在庫切れとなる場合があります。その場合は速やかにご連絡のうえ、ご注文をキャンセルし、お支払い済みの場合は全額返金いたします。

第5条　返品・交換

1. 商品に破損、誤配送その他当ショップに起因する不備があった場合は、商品到着後7日以内にご連絡ください。

2. 交換可能な商品は交換にて対応いたします。

3. 一点物など交換品をご用意できない場合は、ご返金にて対応いたします。

4. お客様都合による返品、交換またはキャンセルはお受けしておりません。ただし、法令により返品等が認められる場合は、この限りではありません。

第6条　知的財産権

本サービスに掲載する写真、文章、ロゴ、デザインその他一切のコンテンツに関する著作権その他の知的財産権は、当ショップまたは正当な権利者に帰属します。法令で認められる場合を除き、無断での転載、複製、改変、配布その他の利用を禁止します。

第7条　禁止事項

お客様は、本サービスの利用にあたり、次の行為を行ってはなりません。

・法令または公序良俗に反する行為

・虚偽の情報による注文

・当ショップまたは第三者の権利・利益を侵害する行為

・本サービスの運営を妨げる行為

・不正アクセスまたはこれを試みる行為

・その他、当ショップが不適切と判断する行為

第8条　サービスの変更・停止

当ショップは、システム保守、通信障害、天災その他やむを得ない事由により、本サービスの全部または一部を変更、停止または終了する場合があります。

第9条　免責事項

1. 当ショップは、本サービスの提供にあたり、法令上認められる範囲で細心の注意を払っておりますが、本サービスの中断、停止または通信環境等に起因する損害について責任を負いかねる場合があります。

2. 当ショップの故意または重過失による場合を除き、本サービスの利用によって生じた損害については、法令の定める範囲内で責任を負うものとします。

3. 消費者契約法その他の法令により免責が認められない事項については、本条は適用されません。

第10条　個人情報

当ショップは、お客様の個人情報を「プライバシーポリシー」に従い、適切に取り扱います。

第11条　規約の変更

当ショップは、法令の変更やサービス内容の変更等に応じて、本規約を変更することがあります。変更後の規約は、本サービス上に掲載した時点から効力を生じます。

第12条　準拠法・裁判管轄

1. 本規約は日本法に準拠します。

2. 本サービスに関する紛争については、当ショップ所在地を管轄する地方裁判所または簡易裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions governing the use of the online shop operated by Round and Round (hereinafter referred to as “the Shop”; the online shop hereinafter referred to as “the Service”). By using the Service, customers are deemed to have agreed to these Terms.

Application

1. These Terms apply to the use of the Service and govern the relationship between the customer and the Shop.

2. Any information regarding shipping, returns, payments, and other matters provided by the Shop through the Service shall constitute part of these Terms.

3. In the event of any inconsistency between these Terms and specific information or guidelines provided by the Shop, the specific information or guidelines shall prevail.

Orders and Sales Contracts

1. A sales contract shall be deemed to have been concluded when the customer places an order through the prescribed method and the Shop accepts the order.

2. The Shop may cancel an order or terminate a sales contract in any of the following circumstances:

・The order contains false or fraudulent information.

・Payment cannot be completed.

・The product cannot be sold due to being out of stock, damaged, or for other reasons.

・The product cannot be delivered due to the customer’s prolonged absence, an incorrect or unknown address, or other circumstances.

・The Shop otherwise determines that it is inappropriate to continue the transaction.

Products

1. The Shop sells vintage and other pre-owned items that are not necessarily new.

2. Products may have scratches, scuffs, changes in colour, signs of use, and other characteristics resulting from age and previous use. These are considered inherent characteristics of the products and do not constitute defects.

3. We make every effort to accurately convey the condition of each product through photographs and descriptions. Please review and understand the condition of the product before making a purchase.

4. While we make every effort to ensure that product images accurately represent the actual colours, colours may appear different depending on the customer’s device or viewing environment.

Prices and Availability

1. Product prices shall be those displayed on the respective product pages.

2. While the Shop makes every effort to maintain accurate inventory information, an item may become unavailable depending on the timing of an order. In such cases, we will contact the customer as soon as possible, cancel the order, and issue a full refund if payment has already been made.

Returns and Exchanges

1. If a product arrives damaged, the wrong product is delivered, or there is any other issue attributable to the Shop, please contact us within 7 days of receiving the product.

2. Where an exchange is possible, we will provide a replacement.

3. If a replacement cannot be provided, such as in the case of a one-of-a-kind item, we will issue a refund.

4. We do not accept returns, exchanges, or cancellations due to reasons attributable to the customer. However, this does not apply where returns or other remedies are required or permitted under applicable laws and regulations.

Intellectual Property Rights

Copyright and other intellectual property rights relating to photographs, text, logos, designs, and all other content provided through the Service belong to the Shop or the respective rightful owners. Unless otherwise permitted by applicable laws, unauthorized reproduction, copying, modification, distribution, or other use of such content is prohibited.

Prohibited Activities

Customers shall not engage in any of the following activities when using the Service:

・Activities that violate laws, regulations, or public order and morals

・Placing orders using false information

・Activities that infringe upon the rights or interests of the Shop or any third party

・Activities that interfere with the operation of the Service

・Unauthorized access to the Service or attempts to gain such access

・Any other activities that the Shop deems inappropriate

Changes, Suspension, and Termination of the Service

The Shop may change, suspend, or terminate all or part of the Service due to system maintenance, communication failures, natural disasters, or other unavoidable circumstances.

Disclaimer

1. The Shop takes the utmost care in providing the Service to the extent required by applicable laws. However, the Shop may not be liable for damages arising from the interruption or suspension of the Service, communication failures, or other circumstances beyond the Shop’s reasonable control.

2. Except in cases of intentional misconduct or gross negligence by the Shop, the Shop shall be liable for damages arising from the use of the Service only to the extent required by applicable laws.

3. This Article shall not apply to matters for which exemption from liability is not permitted under the Consumer Contract Act or other applicable laws and regulations.

Personal Information

The Shop will handle customers’ Personal Information appropriately in accordance with its Privacy Policy.

Changes to These Terms

The Shop may amend these Terms in response to changes in applicable laws, changes to the Service, or other circumstances. Any revised Terms shall take effect when they are published on the Service.

Governing Law and Jurisdiction

1. These Terms shall be governed by and construed in accordance with the laws of Japan.

2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction, as the court of first instance, of the district court or summary court having jurisdiction over the location of the Shop.
